The website www.monsieurpapier.fr is the exclusive property of Studio Lino SAS. Any reproduction or use, in whole or in part, of one or more elements making up the website, on any medium whatsoever, is strictly prohibited without prior authorization. Monsieur Papier creations are protected by copyright. Any use of Monsieur Papier creations by a third party must be subject to prior approval from Studio Lino SAS.
Article 1: Scope and Amendments to the General Terms and Conditions of Sale
These General Terms and Conditions of Sale apply to all orders placed on the online store www.monsieurpapier.fr, owned and operated by Studio Lino SAS.
They come into effect on the date the order is confirmed and remain valid for the period necessary to provide the goods and services purchased until all applicable warranties have expired.
Studio Lino SAS reserves the right to amend these General Terms and Conditions of Sale at any time. The terms in force on the date the order is confirmed shall apply to each order. By placing an order on www.monsieurpapier.fr, the buyer acknowledges having read and accepted these General Terms and Conditions of Sale before confirming the order. The buyer is informed that acceptance of these terms does not require the signing of this document.
These General Terms and Conditions express the entire rights and obligations of the parties within the framework of the online sale of goods and services offered by Studio Lino SAS to the buyer. As such, the buyer is deemed to accept all provisions of these General Terms and Conditions without reservation.
For its part, Studio Lino SAS undertakes to fulfill its obligations as seller under these terms. The products offered comply with current French legislation and the standards applicable in France. The photographs, texts, information, specifications, and descriptions of the products are the property of Studio Lino SAS and may be modified without prior notice. The buyer is informed that, for technical reasons, the visual appearance and color rendering on a computer screen may not exactly match reality. Studio Lino SAS undertakes to publish product photographs that are as accurate as possible.
Article 2: Product Information and Availability
Studio Lino SAS presents on its online store www.monsieurpapier.fr the products offered for sale and the information enabling the prospective buyer, in accordance with Article L111-1 of the French Consumer Code, to know the essential characteristics of the products before confirming an order.
Product offers are valid while stocks last. The availability of the ordered product(s) is verified upon receipt of payment.
Special orders (product customization, bespoke products, bulk orders, etc.) may be carried out upon request. The buyer will be informed of the price and the specific delivery timeframe. The order will be considered confirmed upon receipt of payment and may not be canceled or refunded under any circumstances.
Article 3: Prices
Prices are stated in euros, inclusive of all taxes (VAT included), and exclude shipping costs. The buyer must pay shipping costs unless benefiting from a special offer providing free shipping.
Shipping costs, payable by the buyer, vary depending on the weight and volume of the order. They are specified before the order is confirmed and cannot be disputed afterward.
For deliveries outside the European Union, the customer must pay any customs duties, VAT, or other taxes due upon importation of the products into the destination country. Any related formalities are also the sole responsibility of the customer. The customer alone is responsible for verifying whether the ordered products may legally be imported into the destination country. Studio Lino SAS reserves the right to change its prices at any time, particularly in the event of increased costs, VAT changes, or manifest error. If a price change occurs on the day the buyer places the order, the total price displayed at the time of order confirmation remains the guaranteed price for that order.
Article 4: Payment Terms and Security
Payment in full must be made at the time of ordering. Under no circumstances shall the amounts paid be considered deposits or advance payments. The buyer may pay securely online by credit card or through a PayPal account. A PayPal account is not required to pay online by credit card. Credit card data is encrypted and never transmitted in plain text over the network. Payment is made directly to the bank. Studio Lino SAS never has access to this information. Therefore, the buyer must provide it for each transaction. Upon request, the buyer may also pay by check or bank transfer; the order will only be processed once the check has cleared or the bank transfer has been received. If paying by check, it must be issued by a bank located in mainland France. Processing and shipping times are calculated from the date Studio Lino SAS receives the payment. The buyer guarantees that they have any necessary authorization to use the chosen payment method when confirming the order. Studio Lino SAS reserves the right to refuse to fulfill an order if payment has been refused by the bank or if the buyer has failed to pay in full for a previous order or is involved in an ongoing payment dispute. Products sold remain the full property of Studio Lino SAS until full payment of the order, including all fees and taxes. Risk in the goods passes to the customer upon delivery.
Article 5: Delivery Terms
Products are delivered to the address provided by the buyer when placing the order.
Delivery times: Orders are prepared and shipped no later than 20 business days after payment is received. For mainland France, delivery is made by La Poste or by courier. Transit time is generally 2 to 3 days. For Europe and other countries, delivery may take between 3 and 20 business days. These are average delivery times and depend on the destination, shipping method, and product availability.
Delivery address: The buyer must ensure that the delivery address provided when ordering is accurate. Parcels returned to Studio Lino SAS due to an incomplete or incorrect address will be kept by Studio Lino SAS. They may be resent to the buyer upon request and at the buyer's expense.
Acceptance of delivery: The buyer must check the condition of the packaging and verify that the goods conform to the order upon delivery. Any anomalies concerning delivery (damaged parcel, missing product, etc.) must be noted on the delivery slip as handwritten reservations accompanied by the buyer's signature. The buyer must also confirm these reservations by registered mail to the carrier no later than two business days after receipt of the parcel and send a copy of this letter within the same timeframe to Studio Lino SAS, 59 rue des Langoustiers, Lescoff, 29770 Plogoff.
If products need to be returned, they must be returned by the buyer within two business days of delivery. Products must be returned in their original packaging and must not have been used. Any incomplete returned product will be retained by Studio Lino SAS without any possibility of recourse
Article 6: Liability
Neither Studio Lino SAS nor the buyer shall be held liable for failure to perform the contract due to unforeseen circumstances or force majeure, such as earthquakes, storms, lightning, floods, fires, disruptions or blockages of transportation or supply systems, partial or total strikes affecting postal services, transportation and/or communications, unavailability of telecommunications networks, or any other unforeseeable, unavoidable event beyond the parties' control that cannot reasonably be prevented. The affected party shall notify the other party within ten business days of becoming aware of such circumstances. The parties shall then meet within 30 days to agree on the conditions under which the contract will continue or decide to terminate it. If the force majeure event lasts more than three months, these General Terms and Conditions may be terminated by the injured party. The choice and purchase of a product are the sole responsibility of the buyer. Total or partial inability to use the products, particularly due to equipment incompatibility, shall not give rise to compensation, reimbursement, or liability on the part of Studio Lino SAS.
Article 7: Right of Withdrawal
In accordance with Article L.121-20 of the French Consumer Code, the buyer has a period of fourteen clear days from receipt of the order to exercise the right of withdrawal with Studio Lino SAS and return the products without providing any reason or paying penalties, except for return shipping costs. This right of withdrawal does not apply to special orders, which may under no circumstances be exchanged or refunded.
Return procedure and costs: The buyer has 14 days after communicating the decision to withdraw to return an item.
Products must be returned in their original packaging, together with all accessories where applicable. The buyer must include a copy of the purchase invoice with the parcel. Any incomplete, damaged, deteriorated, or soiled returned product will not be accepted, exchanged, or refunded.
Studio Lino SAS undertakes to reimburse all sums paid, including delivery costs, no later than 14 days from the date on which it is informed of the buyer's decision to withdraw.
Return shipping costs in the event of withdrawal are borne by the buyer. In all cases, products are returned at the buyer's own risk.
Article 8: Warranties and After-Sales Service
Without prejudice to the above right of withdrawal, the buyer benefits from the legal guarantee of conformity under Article L217-4 et seq. of the French Consumer Code and the legal warranty against hidden defects under Articles 1641 et seq. of the French Civil Code.
The legal guarantee of conformity applies independently of any commercial warranty that may be granted.
When relying on the legal guarantee of conformity, the buyer:
- has a period of two years from delivery of the goods to take action;
- may choose between reimbursement, repair, or replacement of the goods, subject to the cost conditions set out in Article L217-9 of the French Consumer Code;
- is not required to prove the existence of the conformity defect during the two years following delivery.
When relying on the legal warranty against hidden defects under Article 1641 of the French Civil Code, the buyer may choose either to cancel the sale or obtain a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
In the event of a refund request due to non-conformity, Studio Lino SAS will cover the return costs and reimburse the returned product, the original shipping costs, and the return costs incurred by the buyer.
In the event of an exchange or replacement following the return of a non-conforming product, Studio Lino SAS will reimburse the return shipping costs and bear the cost of sending the replacement product.
Article 9: Confidentiality
The buyer is informed that personal data is collected when the order is confirmed in order to enable Studio Lino SAS to process the order, notify the buyer of any delays, and keep the buyer informed of new products or promotional offers. Studio Lino SAS undertakes not to disclose the buyer's name or contact details to any third party.
The buyer is informed of the right to register on the BLOCTEL telephone marketing opt-out list, managed by OPPOSETEL: bloctel.gouv.fr.
At any time, the buyer has the right to access, modify, correct, and delete personal data concerning them (Article 34 of the French Data Protection Act of January 6, 1978). To exercise this right, the buyer must send a letter to Studio Lino SAS, 59 rue des Langoustiers, Lescoff, 29770 Plogoff, or an email to: [email protected].
Article 10: Partial Invalidity and Waiver
If one or more provisions of these General Terms and Conditions are held to be invalid or declared invalid under a law, regulation, or final decision of a competent court, the remaining provisions shall remain fully effective. Failure by either party to enforce any breach by the other party of any obligation under these General Terms and Conditions shall not be interpreted as a waiver of the obligation concerned for the future.
Article 11: Applicable Law, Jurisdiction, and Mediation
These Terms and Conditions of Sale and all relationships arising from the connection to and use of this website are governed by French law.
In the event of a dispute, the buyer may bring proceedings before either one of the courts having territorial jurisdiction under the French Code of Civil Procedure or the court for the place where the buyer resided at the time the contract was concluded or when the harmful event occurred.
